new stimulus: employer must pay you for 90 days after you're laid off?
Asked by wendyisrad
I was recently laid off from my job and was told by someone that with a new stimulus passing, if you are to get laid off or downsized, your employer must pay you full pay and benefits (if you have them) for 90 days from the date you are laid off. It is separate from COBRA. I've searched online and can't seem to find anything. Has anyone heard of such a thing? It seems too good to be true. Also, I live in New York state in case this is a state thing and not federal. Any input is appreciated! Thanks! never quite understood why everyone is a dick on yahoo answers... simple question, should be a simple answer.

There's a good reason why you can't find anything about it. Like most things that sound too good to be true, it isn't true. Whoever told you that was incorrect or just lying to you. They might have been thinking of WARN laws, where for cases of plant closings or layoffs of over a certain % of the employees, an employer must give advance notice - length of notice varies by location, there is a federal WARN law and some states have stricter laws.

The only change I know of is that cobra was extended. Employers don't have to pay you any severance at all. NY is an at-will employment state, they can let you go at any time.

That's the most ridiculous thing I ever heard of - that's not saving the company any money. The only thing they did was extend the time that you can be covered under COBRA, as well as extend the number of weeks you can collect unemployment.
